REAL ESTATE AUCTION |
1. TERMS: A deposit is required at time of Auction. Amount will be posted at
the website and announced at
auction. Or you may call our office. Deposit must be in the
form of cash, bank/cashier's check, or certified
check. Balance due at closing. Closing to take place on or
before 30 days following the day of the Auction.
Check may be made payable to bidder, endorsable to Trust
Account.
2. BIDDER REGISTRATION: Although there is no obligation to bid, all prospective
buyers must register in order
to bid at the Real Estate Auction. As part of the
registration process, you will be asked to verify (check
number) that you have cash, bank/cashier's check or certified
check in your possession, payable to yourself
and endorsable to trust account, to enable you to make the
necessary deposit if you are the successful
bidder.
3. AUCTION TYPES: Properties may be offered through any of the following Auction
methods:
A) Absolute Bid - The property will be sold to the highest
bidder regardless of price.
B) Minimum Bid - The property will be sold to the highest
bidder at or above the published price.
C) Reserve Bid - The property will be sold to the highest
bidder at or above the unpublished price.
4. CONDITIONS OF THE AUCTION: The Auctioneer's decision is final in the event of
a dispute over any Auction
matter. The Auctioneer reserves the right to accept bids in
any increments he/she feels are in the best
interest of the client(s). The Auctioneer reserves the right
to bid on behalf of any absentee buyer, providing
the proper Absentee Bid Form has been completed. All Auction
Sales and Purchase Contracts will be
presented to the Seller for final approval. The Auctioneer
reserves the right to withdraw any property
including Absolute Sales from the Auction, without penalty.
The Auctioneer may elect to cancel the Auction
without penalty if the Auctioneer believes the outcome will
not be in the Seller's best interest. If the Seller
is not present, the Auctioneer may elect to start or cancel
the Auction without penalty. The Auctioneer
shall be held harmless by Buyer and Seller should the
property fail to go to a successful settlement for any
reason. The Seller, the Auctioneer and its agents shall not
be held liable for any errors and omissions
regarding Auction property.
5. DUE DILIGENCE: Buyer assumes responsibility to check with the appropriate
authority/authorities regarding
the property's zoning and current or future intended use as
well as any restrictions or covenants affecting
the property. Bidder(s) have the right and should examine the
applicable county master plan and any
municipal land use plans and maps for the area in which the
property is located prior to bidding. The Seller,
Auctioneer and Agents assume no responsibility for the
information contained in said plan(s) and assume no
liability for failure by buyer to review the plans and
encourage the bidder's to perform a thorough process of
"due diligence" and inspections prior to the auction. The
Contract for Purchase will not be contingent upon
bidder(s) review of such plans or inspections. No contingency
contracts will be accepted.
6. TITLE: A guaranteed certificate of title will be provided at Seller's expense
giving marketable title at closing,
subject to deed restrictions of record. The buyer shall be
responsible for all other closing cost associated
with the Sale.
7. TAXES: All taxes paid and prorated State of Florida method at closing.
8. AGENCY: Hofacker and Associates is the seller's agent.
9. BUYER'S PREMIUM : A Ten Percent (10%) buyer's premium will be added to the
final bid to establish the final
Sale Contract Price. It is clearly understood by the Buyer,
that Hofacker and Associates represents the
Seller and that this Buyer's Premium in no way implies an
Agency relationship between the Auctioneer and
Buyer.
10. MORTGAGE FINANCING: Financing is not a condition of the Purchase Contract.
It is recommended that the
Bidder does his/her due diligence (pre-qualification)
in regards to being able to perform financially within the
allotted closing period.
11. PROPERTY INSPECTION: The Bidder acknowledges that he/she has inspected the
Property and will be
purchasing the property "As is - Where is".
12. LEASED PROPERTIES: All leased properties will be sold subject to existing
leases and subject to tenant's
rights under state and local statutes.
13. WARRANTEES: There are no expressed or implied warranties on the property or
properties and are being
sold "As is - Where is".
14. FORMS: Bidder acknowledges that he has reviewed prior to bidding the
appropriate forms, if applicable, as
may be required by the State in which the auction is
being held.
15. DISCLAIMER: All the information, whether written or verbal, has been derived
from sources believed to be
correct, but not guaranteed. All property dimensions
are only approximations. Buyers shall rely entirely on
their own judgment, inspections and due diligence. Any
other terms and conditions announced the day of
Auction will take precedence over printed material.
16. BROKER PARTICIPATION: Broker participation is welcomed.
